These Terms and Conditions constitute a legally binding agreement between Fin Campers (hereinafter "the Company") and the Renter (hereinafter "the Client"). By signing the Rental Agreement or accepting the vehicle keys, the Client acknowledges and agrees to be bound by the following provisions.

Vehicle Use and Client Obligations

1.1

The vehicles provided by Fin Campers are intended solely for recreational rental purposes. Only clients who have fulfilled all pre-rental obligations, including identification verification and payment, are authorized to operate the vehicle.

1.2

The Client is responsible for the vehicle from the moment of check-in until the final check-out is completed and signed by a Company representative. The Client must comply with all local traffic laws and Fin Campers' internal safety policies.

Geographical Restrictions and Border Crossing

2.1

Authorized vehicles are permitted to be driven within the national territories of Chile and Argentina. Border crossing requires prior written authorization and the acquisition of the mandatory international insurance (Mercosur Insurance), which is the Client's responsibility unless stated otherwise.

2.2

Excluded Zones: Fin Campers reserves the right to restrict travel to specific regions based on weather conditions, civil unrest, or road safety reports. Driving into unauthorized "Red Zones" notified at check-in will result in a total breach of contract.

Road Restrictions and Liability

3.1

Permitted Roads: Vehicles must only be driven on officially recognized roads that are in good condition, including paved highways and well-maintained gravel (ripio) roads.

3.2

Prohibited Terrain (Off-Roading): Under no circumstances shall the vehicle be driven "off-road." The Client assumes full financial responsibility for damages, recovery costs, and specialized assistance in the following areas:

  • Off-road trails, dunes, or non-mapped paths.
  • Riverbanks, riverbeds, and flood zones.
  • Areas designated as unfit for motor vehicles.
  • Situations where the vehicle is bogged in mud or trapped by snow/ice outside of a maintained road.

Security Deposit

4.1

A security deposit is mandatory for all rentals and must be processed during the check-in via credit card pre-authorization. The specific amount depends on the Protection Plan selected by the Client.

4.2

This deposit serves as a guarantee for potential damages, fuel shortages, traffic fines, or late returns. The hold will be released after a full technical inspection at check-out, subject to bank processing times.

Protection Plans and Liability Limits

5.1

Fin Campers offers different tiers of protection to limit the Client's financial exposure in the event of an accident occurring within the "Authorized Areas" (defined as the vertical projection of the vehicle's door lines and bodywork).

Support and Service Failure

6.1

24/7 Assistance: Fin Campers provides round-the-clock customer support for clients currently on the road, as well as assistance before and after the trip duration.

6.2

Service Guarantee: In the event that Fin Campers fails to provide a specific service or "add-on" included in the initial booking (e.g., extra equipment), the Company will issue a proportional refund based on the amount paid for that specific item or service.

Breach of Contract and Total Liability

The Protection Plans and Maximum Liability limits mentioned in Clause 5 will be voided, and the Client will be held liable for the full cost of all damages (total loss included), recovery, and third-party claims if:

  • The vehicle is driven in prohibited/off-road zones.
  • The driver is under the influence of alcohol, drugs, or restricted medication.
  • The vehicle is used for illegal activities or subletting.
  • The damage is caused by gross negligence or intentional misuse.
